1. Overview. This website is operated by Golden Bay Coffee LLC, doing business as Castro Coffee Company ("we", "us"), 419 Castro Street, San Francisco, CA 94114. By visiting the site or buying from us, you agree to these Terms, our Privacy policy, Shipping policy, and Return and refund policy. If you don't agree, please don't use the site.
2. Eligibility. You must be at least 18, or using the site with a parent or guardian's permission, to place an order or create an account.
3. Products. We describe our coffees as accurately as we can. Tasting notes are a guide: coffee is a natural product and its flavor can vary from lot to lot and roast to roast. Photos and label images are for illustration.
4. Prices and availability. Prices are in US dollars and may change without notice; the price you pay is the one shown at checkout. Products can sell out or be discontinued. If an item is listed at a clearly wrong price, or becomes unavailable after you order, we may cancel that item or order and give you a full refund.
5. Orders and payment. Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if we suspect fraud. You agree to give accurate payment, contact and shipping details. Payments are processed securely by Shopify and its payment partners; we don't store your full card details.
6. Shipping, returns and refunds. These are covered by our Shipping policy and Return and refund policy, which form part of these Terms.
7. Subscriptions. If you subscribe, our Purchase options cancellation policy also applies.
8. Gift cards. Gift cards don't expire and can be used on our website. They can't be redeemed for cash, except that, as California law requires, a balance under $10 can be redeemed for cash on request. Treat your gift card code like cash; we aren't responsible for lost or stolen codes.
9. Your account. You're responsible for keeping your login details safe and for activity on your account. Tell us right away if you think your account has been used without your permission.
10. Acceptable use. Don't use the site for anything unlawful, to interfere with its security or operation, to send spam or malware, or to scrape or copy it in bulk.
11. Intellectual property. The site's content, including text, photos, labels, logos and design, belongs to us or our licensors. You may not copy or reuse it for commercial purposes without our written permission.
12. Reviews and feedback. If you send us reviews, comments or suggestions, you allow us to use them, including on the site, without payment. Don't submit anything unlawful, misleading or that infringes someone else's rights.
13. Third-party links and services. The site may link to or use other services (such as carriers, maps and payment providers). We aren't responsible for their content or practices.
14. Disclaimer. Apart from the promises in our policies, the site and our products are provided "as is" and "as available", to the extent the law allows. We don't guarantee the site will always be available or error-free.
15. Limitation of liability. To the extent the law allows, we aren't liable for indirect, incidental or consequential losses, and our total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these Terms limits rights you have under consumer protection law that can't be waived.
16. Indemnity. You agree to cover our reasonable losses if you break these Terms or the law in using the site.
17. Governing law. These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in San Francisco County, California, except that either of us may bring a claim in small-claims court.
18. Changes. We may update these Terms. The date at the top shows the latest version; changes apply to orders placed after that date.
